On December 26 2012 Mike Fisher filed his petitions for Mayor for the April 2013
general election. Mayor Bolander filed an objection to the filing based on the one year
residency requirement. State statute says that he would have had to reside in Newton
for one year prior to the April 9 2013 election.
On January 10 there was a hearing before the city of Newton Election committee to
hear the objection to Mike Fisher’s petitions. The committee consisted of City
Collector Alice Addis, Aldermen Bloomberg and Alderman Reisner.
Testifying at the hearing was Jasper County Illinois clerk and local election official
Linda Huth, Mike Fisher and Alderman Harold Bolander (Mayor Bolanders uncle).
When Mike Fisher testified he produced utility bills addressed to his Newton
Residence well prior to April 2012.
Harold Bolander testified that he lived near the Mike Fisher residence and there were
many times after April 2012 when he did not see Mike Fisher’s vehicle in his
driveway all the time. When cross examined by Mike Fisher he admitted that since
Mike has a enclosed garage he does not know when he is home or not.
Jasper County clerk Linda Huth testified that Mike did not meet the eligibility
requirement because he had not registered to vote in Newton Prior to April 2012 and
voter registration was what determined where your official residence is.
The committee then “deliberated “ before delivering a pre-typed decision that
determined that Mike did not meet the eligibility requirement and therefore would not
be on the ballot for Mayor on April 9 2013.
WHAT A JOKE, first how about the makeup of this panel that is ostensibly supposed
to deliver some sort of impartial ruling based on facts and state statutes.
Alice Addis:City collector and deputy city clerk, a position appointed by the mayor
and he could just as easily appoint someone else.
Alderman Reisner and Bloomberg: Both are big fans of small city government with
the big city feel that Mayor Bolander is all about and would not want to see anything
happen to this.
Now how about the facts of the case.
It all came down the County Clerk Linda Huth’s testimony that Mike Fisher did not
meet eligibility requirements because of the fact that he had not registered to vote in
Newton prior to April 2012, Mrs Huth being the county clerk had the date when Mike
had registered to vote and it was after April 2012. The problem with this is the fact
THAT THERE IS NO SUCH STATE STATUTE. The state statute clearly states that
you have to be registered to vote 30 days prior to the filing date, not one year. He
registered on September 26 2012

For this hearing Alderman Bloomberg moves from the judges seat across the table to
the defendants seat and Mayor Bolander makes a similar move from the Objectors
seat to the judges seat. In case you did not get that they actually both got up and
switched seats, it was on of the funniest things that I have ever saw.
The committee now consists of Mayor Bolander, City Collector Alice Addis and
Alderman Reisner.
Alderman Bloomberg filed his petitions for Alderman 17 days after the state statute
mandated deadline for established political parties of November 26, 2012.
Alderman Bloombergs late filing was objected to by Diane Hickox.
Jasper County Clerk Linda Huth TESTIFIED UNDER OATH that Alderman
Bloomberg had in fact meet the filing date requirement.
The election committee once again deliberates and finds that Alderman Bloomberg
has meet the filing deadline and is indeed eligible to be on the April 9 2013 ballot.
And once again they present a pre-typed decision.
Wow!! Completely ignoring the irrefutable fact of the late filing by just saying that he
filed on time.
I have heard about Kangaroo court before but this was the first time that I actually saw
one.
Here is why it meets the definition of a kangaroo court.
1. The judges were directly affected by the outcome.
2. They had a pre-typed decision before the hearing started.
3. They ignored verifiable facts.
4. They ignored state statutes.
5. Bloomberg and Bolander took turns judging each other.
Jasper County Illinois clerk Linda Huth clearly put her desire for the outcome of both
hearings above facts and law. She TESTIFIED UNDER OATH that Mike Fisher was
not eligible because he had not registered to vote one year prior. This was not
factual. She TESTIFIED UNDER OATH that Alderman Bloomberg had his petitions
filed on time and was eligible. This was not factual. The deadline for filing was
November 26.
At the next county clerk election you really should consider if it a good idea to have a
County clerk whose duties include local election official that would totally disregard
facts and law when carrying out her duties as the local election official.
